LegacyWorks – Terms of Service

1. Description of Services
LegacyWorks provides custom obituary writing, memorial programs, creative tributes, and
related services. All work is created based on the information provided by the client.
2. Client Responsibilities
Clients agree to:
● Provide accurate and complete information.
● Review drafts thoughtfully and promptly.
● Respond within 48 hours for revisions or clarifications.
● Ensure all submitted photos or text belong to them or they have permission to use.
3. Intellectual Property
All written content created by LegacyWorks remains the intellectual property of LegacyWorks
until full payment is received.
After payment, clients receive full usage rights for personal, memorial, or publication purposes.
LegacyWorks retains the right to use anonymized portions of text for portfolio or training
purposes unless the client requests otherwise.
4. Turnaround Times
Standard turnaround times are based on the package purchased.
Delays due to incomplete client information are not the responsibility of LegacyWorks.
5. Revisions
Revisions included vary by package.
Additional revisions beyond the package rate are billed at: $35 per revision.
6. Limitations
LegacyWorks is not responsible for:
● Incorrect information submitted by the client
● Printing delays caused by third-party vendors
● Service disruptions due to emergencies, natural disasters, or technology failures
7. Refusal of Service
LegacyWorks reserves the right to refuse or terminate services due to:
● Abusive communication
● Repeated scope changes
● Non-payment
● Requests outside the ethical or professional boundaries of memorial writing
8. Payment & Refunds
All payments are subject to the LegacyWorks Payment Policy and Refund Policy.
9. Governing Law
These terms are governed by the laws of the State of Illinois.

LegacyWorks is committed to protecting the privacy and security of our clients, especially during
moments of grief.
1. Information We Collect
We collect:
● Contact information
● Family details
● Personal stories willingly submitted
● Photos submitted for obituary/program use
● Payment details (processed via secure third-party processors)
2. How We Use Information
We use your information to:
● Write custom obituaries and memorial documents
● Provide customer support
● Deliver digital files
● Improve our services
3. How We Protect Your Information
● Secure, encrypted servers
● Limited internal access
● Data stored only as long as necessary
4. Sharing of Information
We do not sell, trade, or share client information with third parties.
Information may be shared only with your explicit consent or if legally required.
5. Data Retention
Obituaries and documents are stored for up to 12 months unless the client requests earlier
deletion.
6. Your Rights
Clients may request:

3. PAYMENT POLICY
LegacyWorks – Payment Terms
1. Payment Due at Time of Order
All services require half payment down upfront before work begins.The remaining portion of bill
is due after stream line, revisions and final review before print order is submitted.
2. Accepted Payment Methods
● Credit/Debit Cards
● PayPal
● CashApp (business version)
● Zelle (optional)
3. Rush Fees
Rush fees are added at checkout and are non-refundable.
4. Additional Charges
If client requests:
● Extra revisions
● Additional layouts
● Expanded word count
These may be billed separately.
5. Non-Payment
If payment is not received:
● Work will not begin
● Orders may be cancelled after 48 hours
● Chargebacks will result in immediate service termination
6. Refunds
Handled according to the official LegacyWorks Refund Policy

DISPUTE RESOLUTION CLAUSE

LegacyWorks – Dispute Resolution
In the rare event of disagreement, both parties agree to the following process:
1. Step One: Internal Resolution
Client will first contact LegacyWorks support to attempt a good-faith resolution.
2. Step Two: Mediation
If unresolved, both parties agree to voluntary mediation using a neutral third party in Cook
County, Illinois.
3. Step Three: Arbitration
If mediation does not resolve the issue, both parties agree to binding arbitration.
Arbitration replaces the right to sue in court.
4. Exceptions
LegacyWorks may pursue legal action for:
● Fraud
● Chargebacks
● Defamation
● Non-payment
